Rhea Chakraborty Arrested: Special Court Observed That Drug Quantity Not Required To Prove Financing Illicit Trafficking-Report
Rhea Chakraborty and her brother Showik Chakraborty are arrested by the Narcotics Control Bureau in connection to the drugs angle in the Sushant Singh Rajput death case. It was recently that the Chakraborty’s lawyer filed a bail plea in the special court, which was rejected. After Rhea Chakraborty and brother Showik Chakraborty’s bail plea was rejected by the special court, as per Mumbai Mirror report, the court observed that they have been booked under a section of the NDPS act that does not require a number of drugs to prove the offence.

According to a report in Mumbai Mirror, the special court that denied bail to Rhea Chakraborty and her brother Showik observed that the siblings have been booked under a section of the Narcotic Drugs and Psychotropic Substances (NDPS) Act that does not mention that a quantity of the banned substances is needed to prove the crime.  Judge GB Gurao observed, “It is pertinent to note that in section 27-A (punishment for financing illicit traffic and harbouring offenders) of the NDPS Act, no particular quantity of the drug is required to prove the offence.”

For the unversed, Rhea Chakraborty and Showik’s bail plea before the special court pleaded that the alleged quantity of marijuana was under the bar used for commercial quantities. In the plea made by Rhea and Showik, they said that, according to the law, the maximum punishment was not of more than a year of imprisonment. As the Chakraborty’s lawyer Satish Maneshinde argued that the NCB has applied section 27-A ‘mechanically and without application of mind’ against Rhea and Showik, the judge observed Showik’s statement to the NCB where he “admitted that he was making payment of the drug and therefore it is clear that the accused has financed (sic) to illicit trafficking of the drug.”

Meanwhile, so far, apart from Rhea Chakraborty and Showik Chakraborty, SSR’s house manager Samuel Miranda, housekeeper Dipesh Sawant and drugs peddlers have been arrested by the NCB.
