Salman Khan Wins Big As Delhi High Court Orders Immediate Takedown Of 'Kala Hiran' Teaser, Upholds His Personality Rights.
In a major legal victory for Salman Khan, the Delhi High Court has ordered the immediate removal of the teaser and related promotional content of the upcoming film Kala Hiran: The Battle for Legacy, observing that the material prima facie violates the superstar's personality rights and could seriously harm his reputation.
Justice Jyoti Singh, while passing the interim order on July 27, directed the filmmakers to take down the teaser and associated online posts after Salman objected to the unauthorised use of his persona. The court held that the makers could not commercially exploit the actor's name, mannerisms, or other distinctive attributes without his consent.
The court also noted that the teaser appears to draw references to incidents connected to the actor's pending appeal in the 1998 blackbuck poaching case and allegedly attributes acts of witness intimidation and interference with the investigation. According to the court, such portrayals could cause irreparable damage to Salman's goodwill and reputation, especially given the widespread reach and permanence of digital platforms.
Emphasising the significance of reputation, the court observed that it is built over years of effort and, once lost, is difficult to restore. It further remarked that the rapid dissemination of allegedly defamatory content through social media only magnifies the potential harm.
The order comes as interim relief in Salman Khan's ongoing legal battle against the makers of Kala Hiran, who have been accused of creating promotional material that unmistakably alludes to the actor without his authorisation. The case will continue to be heard as the court examines the broader issues surrounding personality rights and the film's proposed release.
