MP High Court Quashes Ekta Kapoor’s Petition For Dismissing A Case Filed Against Her For Streaming Objectionable Content On XXX Season 2
In June this year, Ekta Kapoor owned OTT platform ALT Balaji’s web show XXX season 2 courted controversies for hurting religious sentiments. An FIR was filed against the show producer Ekta Kapoor under IPC sections 294 (obscenity), 298 (hurting religious feelings), and relevant provisions of the IT Act and the State Emblem of India (Prohibition of Improper Use) Act. Now in a recent development, Madhya Pradesh High Court in Indore has dismissed Ekta Kapoor’s petition seeking the dismissal of the case against her for streaming objectionable content.

NDTV quotes Justice Shailendra Shukla, "After due consideration in view of the aforesaid discussions, it appears that facts of the case are not such that this court may exercise its extraordinary powers under Section 482 of CrPC for quashing the FIR at least in respect of Section 67, 67-A of IT Act and Section 294 of IPC."

“Although, it would be fair enough to state that provision of Section 298 of the IPC and the provision of the State Emblem Act are not found to have been breached, Judge Shailendra Shukla said in a reprieve to the producer on two charges,” added the judge further.

While issuing an apology a few months back, Ekta Kapoor’s statement read, “I’d like to reiterate the fact that as a responsible and law-abiding citizen, I have the highest regard for the Indian army. They not only risk their lives at the frontier towards protecting us but are also one of the most-disciplined and honourable organizations in the country. We, at ALTBalaji, have the deepest regard for our valiant soldiers and truly respect them and their families.
