Rakhi Sawant Defamation Case: Actress Exempted From Appearing Before Lower Court; Bombay HC Issues Notice To The Complainant
Over the years, actress Rakhi Sawant is one of the most controversial stars the internet loves talking about. She often makes the headlines for all the wrong reasons. From her tumultuous relationship with her estranged husband Adil Khan Durrani to cases being filed against her, she is always in the news. According to a recent report by the Free Press Journal, on Wednesday, a division bench of Justices PD Naik and NR Borkar granted the actress an exemption from appearing before lower courts in a defamation case filed by a model.

The media publication states that the Bombay High Court issued a notice to the model, after a plea by Sawant that sought quashing of the complaint against her alledging defamation and outraging modesty. As per a First Information Report (FIR) filed on 31 October 2022, the complainant alleged that the Main Hoon Na actress showed ‘sexually explicit’ videos of the model and made defamatory statements against her in front of the media. The offence was registered under Sections 354(A) (outraging modesty of a woman), 500 (defamation), 504 (criminal intimidation), 509 (intent of provoking breach) and 34 (common intention) of the Indian Penal Code (IPC). The 45-year-old actress was also booked under Section 67(A) of the Information and Technology Act (IT Act), which deals with publishing or transmitting any material that contains sexually explicit acts in electronic form. The reality show star’s advocate argued that she cannot be booked under section 354A, as it is only applicable to men. The advocate also added that section 67A of the IT Act isn’t applicable as the complainant herself had recorded the explicit videos and published them on the internet. ALSO READ: DID YOU KNOW? As per the FPJ report, the model herself is an accused in a case registered under section 67A of the IT Act for publishing obscene material. She was reportedly granted a pre-arrest bail by the Supreme Court in a case related to businessman Raj Kundra, Shilpa Shetty’s husband. The hearing for the same will be held on 10 January 2024. Rakhi’s plea contends that the fellow model filed the FIR against her out of revenge.
